Step 1: Foundational Eligibility (Nationality)
The E-2 visa is only available to nationals of countries that have a qualifying treaty of commerce and navigation with the United States.
Citizenship by Investment (CBI) Check
Your selected country is designated as having a Citizenship by Investment (CBI) program. Per the AMIGOS Act, you must meet an additional requirement.
Step 2: The Investment (Substantiality)
Your investment must be “substantial.” This is not a fixed dollar amount but is measured by the “proportionality test” — the ratio of your investment to the total cost of the business.
This means the funds are not just in a bank account. They must be actively spent or committed (e.g., signed lease, purchased equipment, funds in escrow for a business purchase).
Step 3: The Enterprise (Viability)
The business must be a “bona fide” (real and active) enterprise. It also cannot be “marginal,” meaning it must do more than just support you and your family.
You must show the business will make a significant economic contribution. Check all that apply to your 5-year business plan.
Step 4: The Investor (Control & Fund Source)
You must prove you will “develop and direct” the enterprise and that your investment funds were obtained lawfully.
Operational Control Check
Since you own less than 50%, you must prove you have “operational control.”

Step 5: Non-Immigrant Intent
The E-2 is a non-immigrant visa, meaning it is temporary. You must affirm that you intend to depart the U.S. when your E-2 status ends.
Important Note on E-2 Status
While E-2 status can be renewed indefinitely (as long as the business qualifies), it does not provide a direct pathway to a Green Card (Permanent Residency). You would need to qualify for a Green Card through a separate process (e.g., family petition, EB-5 immigrant investor).
