Applying for a Spousal Open Work Permit: Inside Canada vs Outside Canada
Where you are physically located when you submit your Spousal Open Work Permit application changes some of the questions you answer, the status you need to maintain, and what you can do while you wait. Both routes use the same online IRCC application; the details inside it differ.

Same permit, two different application experiences
The eligibility rules are identical whether you apply from inside or outside Canada. What differs is the application itself: the questions IRCC asks, the status declarations you make, and, if you are already in Canada, the temporary resident status you need to hold or restore before or while you apply.
What changes based on where you are
Both applications go through the same IRCC secure online account and use the same IMM 1295 form. The difference is in how you answer the form and what status you need at the time you apply.

Document requirements can also differ slightly depending on whether your spouse is a high-skilled worker, low-skilled worker, or on a permanent-residence pathway. We confirm the exact document list for your specific situation before you apply.
What does not change
The required documents, the IMM 1295 form, and the $255 CAD total government fee are the same in both cases. Both applications are submitted through the same IRCC secure online portal. There is no port-of-entry option for this permit from either location.
We get your status declaration right the first time
An incorrect status selection on an inside-Canada application, or a missed detail on an outside-Canada application, is a common and avoidable cause of processing delays. Amir Ismail & Associates confirms exactly which status and application details apply to your specific situation before submission.
Inside vs Outside Canada Questions
Is it faster to apply from inside or outside Canada?
Processing times depend on IRCC’s current workload for each stream rather than your physical location alone. What matters most is submitting an accurate, complete application regardless of where you apply from.
I am currently in Canada as a visitor. What status do I select?
You generally select “Visitor” if you are working without a permit or otherwise present as a visitor. Selecting the wrong status is a common error that can affect your application.
Can I apply at a port of entry if I am arriving from outside Canada?
No. This permit is submitted online only, through your IRCC secure account, regardless of whether you are applying from inside or outside Canada.
Do the fees differ based on where I apply from?
No. The government fee is $255 CAD total in both cases, plus biometrics if required.
What happens if my temporary status expires while my application is being processed?
If you applied before your status expired and you have maintained status, you generally remain authorized to stay while IRCC processes your application. We confirm your specific maintained-status situation before you apply.
Not Sure Which Application Path Applies to You?
We will confirm your correct status declaration and document list before you submit.
