EB-1A vs EB-2 NIW: Which Self-Filed Green Card Fits You?

Key takeaways
  • Both are green cards you file for yourself on Form I-140, with no job offer and no labor certification.
  • EB-1A judges you and your acclaim: one major award, or at least 3 of 10 criteria, then a review of whether you are at the very top of your field.
  • EB-2 NIW judges your work and its value to the U.S.: an advanced degree or exceptional ability, then the three-part Dhanasar test.
  • Neither is easy, and neither is a promise. The right one depends on your record today.
  • Many people start with the NIW while their record is still building. Your attorney should confirm the order.

Why do people pick the wrong self-filed green card?

Most people pick between the two by which sounds more impressive, not by which test their record fits. USCIS judges each category on its own test, and a filing that does not fit its test can be denied. USCIS filing fees are generally not refunded (USCIS).

Here is how it usually goes wrong. You file EB-1A because the award list looks long, then learn that USCIS asks whether you are among the small percentage at the very top. You file NIW with a vague project because the bar looks lower. Or you assume one approval decides the other.

Underneath, the feelings are real. You feel proud of your record, but unsure which test it fits. You feel impatient, because you want a plan now. And you feel worried about paying for a filing that comes back denied.

None of that means your record is weak. It means no one set the two tests side by side. The table below does that.

Who is behind this comparison, and why trust them?

Amir Ismail & Associates has guided 25,000+ clients since 1991, from offices in Toronto, Dubai and Karachi. We help you measure your record against both tests, and independent U.S. attorneys handle the legal work and the filing. We also tell you straight when another route fits you better.

Empathy: We know how hard it is to judge your own record, and how costly it is to guess.

Authority: Amir Ismail has worked in immigration since 1991. Over 35+ years, our team has guided 25,000+ clients from Toronto, Dubai and Karachi. That includes many people choosing between the United States and Canada.

Philosophy: We believe you should measure your record before you file. We believe a good advisor tells you when the bar is too high today. And we believe you should know exactly who files your case.

How do the EB-1A and the EB-2 NIW compare?

The EB-1A and the EB-2 NIW are both green cards you file for yourself on Form I-140 with no job offer, and they differ most in what USCIS judges. The EB-1A judges you and your acclaim, and the EB-2 NIW judges your work and its value to the U.S. (USCIS). Both require strong evidence, and neither is a promise.

Read across, not down. The second row usually decides it.

Which is easier, the EB-1A or the EB-2 NIW?

Neither is easy, and we have no source that says which is easier. The EB-1A asks for a higher level of proven achievement, while the EB-2 NIW asks for a specific project that serves the national interest. The right one depends on whether your record is already at the top of your field or still building (USCIS Policy Manual).

We cannot tell you either route succeeds at any rate, and no one should promise that.

Can I file both?

Some people pursue both, but each is a separate petition with its own test and its own evidence. A decision on one does not decide the other, because USCIS judges each petition on its own merits. Your attorney will advise whether and in what order to file (USCIS Policy Manual).

Which has the shorter wait?

The Visa Bulletin lists EB-1 and EB-2 on separate charts, and each chart lists some countries separately, so the answer depends on your country of birth. The charts change every month, so we do not print dates on this page. Your attorney will check the current chart for you (U.S. Department of State, USCIS).

Which one should you pick?

If your record already shows sustained acclaim, with major awards or strong proof across at least three criteria, the EB-1A deserves a serious look. If your record is strong but your recognition is still growing, and you have a specific project that serves the U.S., the EB-2 NIW fits better. Always start from what you can prove today, not from what you hope to prove.

Some people file the NIW first and the EB-1A later. Your attorney should confirm the order for your case.

Who this is not for. If you want to work in the U.S. sooner than a green card allows, look at the O-1. If you want a green card through an investment, see the EB-5. If you are Canadian, see EB-2 NIW for Canadians.

How our process works

You take three steps: choose your door, get your route review, and meet an independent U.S. attorney. AIA helps you measure your record and organize your evidence, and the attorney handles the legal work and the filing.

Step 1: Choose your door

For the NIW, book a paid Strategy Consultation with Amir. For the EB-1A, answer the short form.

Step 2: Get your route review

We go over your evidence against both tests and tell you honestly which fits and what to build.

Step 3: Meet an independent U.S. attorney

They confirm your eligibility, advise you on the law, and file Form I-140 for you once they are engaged under your signed agreement.

Questions about cost, time and results

Most people ask three things before they start: what it costs, how long it takes, and whether they will qualify. The answers below are honest and short. If yours is missing, the short form or the consultation lets you ask.

Yes, if your Form I-140 is approved, your spouse and unmarried children under 21 may apply for green cards as derivatives on either route (USCIS). Their applications follow yours. Children who turn 21 may lose eligibility, so timing matters.

You pay different parties for different things: the government, your attorney, and the cost of gathering your evidence, such as expert letters and translations. Government fees are set by USCIS, and each attorney sets their own fees. The NIW starts with a paid Strategy Consultation with Amir, and the booking page shows what it includes.

We do not quote fees on this page.

A weak filing costs more than a strong plan, because government fees are generally not refunded. Measuring your record first is the cheaper path.

No one can promise you will qualify. The short form and the consultation tell you honestly where you stand, including when one route is too early and the other fits better. If a route is a poor match, we say so before you spend money.

A better-fitting route beats a hopeful filing.

What happens if you wait, and what does success look like?

If you wait, you keep guessing, and your evidence drifts without a plan. If you measure your record against both tests first, you file the right one when it is ready, with the right attorney. One consultation or a short form gets you started.

If you stay stuck: another year of wondering which test fits. Awards, papers and projects sit unmapped. A filing that does not fit costs you months and fees you will not get back.

If you act now: you know which test your record fits, you know what to build, and you know who files your case. You feel relieved and confident, because the next step is clear. That is what we help you reach.
