Key takeaways
  • The EB-1A is a green card you file for yourself. No job offer and no labor certification are needed.
  • You must show sustained national or international acclaim. That means at least 3 of 10 USCIS criteria, or one major internationally recognized award.
  • Meeting three criteria is only step one. USCIS then asks whether all your evidence puts you among the small percentage at the very top.
  • You can be early in your career and still qualify. The test is your level of acclaim, not your age.
  • If your record is strong but not at that level yet, EB-2 NIW may fit better. We tell you which.

Why do EB-1A petitions fail?

Most EB-1A problems come from meeting the criteria on paper but not proving you are at the very top of your field. USCIS first checks whether you meet three of ten criteria, then judges all your evidence together to see whether you are among the small percentage at the very top. A petition that stops at step one can be denied, and USCIS filing fees are generally not refunded (USCIS).

Here is how it usually goes wrong. You list awards and papers without showing why they matter. You count a criterion that the evidence does not really meet. Or you file before your record is ready, because the process felt urgent.

Underneath, the feelings are real. You feel proud of your work, but unsure it counts. You feel impatient, because you want a plan now. And you feel worried about paying for a filing that comes back denied.

None of that means your record is weak. It means no one has measured it against the real test. The sections below do that.

Who is behind your EB-1A plan, and why trust them?

Amir Ismail & Associates has guided 25,000+ clients since 1991, from offices in Toronto, Dubai and Karachi. We help you measure your record and plan your evidence, and independent U.S. attorneys handle the legal work and the filing. We also tell you straight when another route, such as EB-2 NIW, fits you better.

Many of our clients are researchers, executives and founders moving between Canada, the Gulf and South Asia.

Empathy: We know how hard it is to judge your own record, and how costly it is to guess.

Authority: Amir Ismail has worked in immigration since 1991. Over 35+ years, our team has guided 25,000+ clients from Toronto, Dubai and Karachi. That includes many people choosing between the United States and Canada.

Philosophy: We believe you should measure your record before you file. We believe a good advisor tells you when the bar is too high today. And we believe you should know exactly who files your case.

What is the EB-1A visa?

The EB-1A is a U.S. green card for people with extraordinary ability in the sciences, arts, education, business or athletics. You can file for yourself on Form I-140, with no job offer and no labor certification, if you show sustained national or international acclaim (USCIS). Your spouse and unmarried children under 21 can apply for green cards through your case.

You must also show you will keep working in your field in the United States. The bar is high on purpose, because the category is for people at the top.

It is a green card, not a visa that expires. Once approved and processed, you and your family hold permanent residence.

Who qualifies for the EB-1A?

You qualify if you show sustained national or international acclaim in your field, through one major award or at least three of ten criteria, and you will keep working in your field in the U.S. USCIS then looks at all your evidence together to decide whether you are among the small percentage at the very top (USCIS). Meeting three criteria alone does not decide the case.

What are the 10 EB-1A criteria?

The 10 criteria are the evidence types USCIS lists for extraordinary ability, and you must meet at least three, unless you have one major award. If a criterion does not fit your field, you may offer comparable evidence with a specific, credible explanation. There is no comparable evidence for the one-time major award (USCIS).

  • Awards: lesser nationally or internationally recognized prizes for excellence.
  • Memberships: membership in associations that demand outstanding achievement of their members.
  • Press about you: published material about you in professional or major trade publications or other major media.
  • Judging: you were asked to judge the work of others, alone or on a panel.
  • Original contributions: original contributions of major significance in your field.
  • Scholarly articles: you authored scholarly articles in professional or major trade publications or other major media.
  • Exhibitions: your work was displayed at artistic exhibitions or showcases.
  • Leading role: you performed a leading or critical role in distinguished organizations.
  • High pay: you command a high salary or other significantly high pay compared with others in your field.
  • Commercial success: commercial successes in the performing arts.
  • Your evidence

            • Yes:

What does sustained acclaim mean?

Sustained acclaim means your recognition has lasted over time and still holds today. USCIS says there is no set number of years, so a young or early-career person can still qualify. If your recognition was in the past, USCIS checks whether you still have a comparable level (USCIS Policy Manual).

Can I qualify early in my career?

Yes, the test is your level of acclaim, not your age or years of experience. USCIS says an early-career person can still qualify if the evidence shows they are at the very top. Factors that may help include publishing in highly ranked journals, high citation rates, work at leading institutions, unsolicited invitations to speak, and competitive U.S. government grants, though none is required (USCIS Policy Manual).

Who this is not for. If your record is strong but you do not yet have wide recognition in your field, the EB-1A may be too early. Look at the EB-2 NIW first, which judges your work and its value to the U.S. instead of your acclaim.

Not sure which side of the line you are on? The short form tells you, in a few minutes.

EB-1A or EB-2 NIW: which fits you?

If your recognition is wide and well documented, look at the EB-1A. If your record is strong but your recognition is still growing, look at the EB-2 NIW. Both are green cards you file for yourself on Form I-140, and some people file NIW first.

Does an O-1 help my EB-1A?

Yes, a prior O-1 approval can help, but it does not decide the case. USCIS calls it relevant and an indicator of eligibility, and it judges each petition on its own merits under the EB-1A standard, which differs from the O-1 standard. Plan your EB-1A evidence as if the O-1 did not exist (USCIS Policy Manual).

See the O-1 page for the temporary visa.

How the EB-1A process works

You take three steps: answer the short form, get your route review, and meet an independent U.S. attorney. AIA helps you measure your record and organize your evidence, and the attorney handles the legal work and the filing.

Step 1: Answer the short form

Tell us your field, your recognition and what evidence you already have.

Step 2: Get your route review

If your answers fit the EB-1A, we call you to go over your evidence and what to build.

Step 3: Meet an independent U.S. attorney

They confirm your eligibility, advise you on the law, and file Form I-140 for you once they are engaged under your signed agreement.

Questions about cost, time and results

Most people ask three things before they start: what it costs, how long it takes, and whether they will qualify. The answers below are honest and short. If yours is missing, the short form lets you ask.

Yes, if your Form I-140 is approved, your spouse and unmarried children under 21 may apply for green cards as derivatives (USCIS). Their applications follow yours. Children who turn 21 may lose eligibility, so timing matters.

You pay different parties for different things: the government, your attorney, and the cost of gathering your evidence. Government fees are set by USCIS, and each attorney sets their own fees. Evidence such as expert letters, translations and reports varies by case.

We do not quote fees on this page.

A weak filing costs more than a strong plan, because government fees are generally not refunded. Measuring your record first is the cheaper path.

It depends on how ready your evidence is, how busy USCIS is, and whether your country has a Visa Bulletin wait for green cards. Premium processing may speed the first decision, but you may still wait for a visa number. We do not quote dates before we review your case, because a guess helps nobody.

The part you control is the start. The short form takes a few minutes, and the route review follows.

No one can promise you will qualify. The EB-1A bar is high, and the short form and route review tell you honestly where you stand, including when the EB-1A is too early. If another route fits better, we say so before you spend money.

That is also why some people leave with the EB-2 NIW instead. A better-fitting route beats a hopeful filing.

What happens if you wait, and what does success look like?

If you wait, you keep guessing, and your evidence drifts without a plan. If you measure your record first, you file when it is ready, with the right attorney. The short form takes a few minutes.

If you stay stuck: another year of wondering whether your record is enough. Awards and papers sit unmapped. A filing that does not fit costs you months and fees you will not get back.

If you act now: you know whether you qualify, you know what to build, and you know who files your case. You feel relieved and confident, because the next step is clear. That is what we help you reach.
