No. Your passport decides, not where you live. The UAE and India are not on the State Department E-2 list, while Canada and Pakistan are, so an expat in Dubai qualifies only if they hold citizenship in a treaty country (U.S. Department of State, Oct 2026).

Many expats in the UAE ask this question. This page shows how to check your own case in a few minutes.

Does residence in the UAE count for the E-2?

No. The E-2 asks for citizenship in a treaty country, as USCIS states. Living, working or holding a residence visa in the UAE does not change your nationality for this purpose (USCIS, Aug 2026).

What if your passport is on the list?

You can use the E-2 from the UAE, and the same tests apply as anywhere else. You must invest a substantial amount at risk, own at least half of the business or control it, and run a real, active business that is not marginal (USCIS, Aug 2026).

Step 1: Confirm your passport is on the E-2 country list.

Step 2: Build a clear paper trail for your funds. Expats often hold money in several countries, so every transfer needs records.

Step 3: Test your budget with the investment amount guide.

Step 4: Take the E-2 eligibility check.

Your attorney will confirm which U.S. embassy or consulate handles your case.

What if your passport is not on the list?

The E-2 is closed to you, and another route may fit. The EB-2 NIW, the EB-1A, the O-1 and the L-1 do not depend on a treaty. The U.S. route finder compares them for your profile. Read about U.S. employment green cards for the permanent options.

Does citizenship by investment help?

It can, but only after a waiting period. If you gained citizenship through a financial investment and have never held E status, you must have lived in that country continuously for at least three years before you apply (Public Law 117-263, section 5902).

What about Canada as another option?

If you also consider Canada, the E-2 vs C11 comparison shows how the two business routes differ.

Frequently asked questions

Can a UAE resident get an E-2 visa?

Only if they hold citizenship in a treaty country. UAE residence does not count, and the UAE is not on the State Department list (U.S. Department of State, Oct 2026).

Is India on the E-2 treaty list?

No. India, mainland China, the UAE and Nigeria are not on the list. Canada and Pakistan are (U.S. Department of State, Oct 2026).

What if I hold two passports?

The treaty-country passport is the one that matters. Confirm the details with your attorney before you plan around it.

What can I do if my country is not on the list?

Look at routes that do not depend on a treaty, such as the EB-2 NIW, the EB-1A, the O-1 and the L-1.

Does my spouse work on the E-2?

Yes. Spouses in valid E-2 status are authorized to work incident to status (USCIS, Aug 2026).

Where to go from here

Start with your passport, then your plan. Take the E-2 eligibility check or use the U.S. route finder.
