A research and development founder qualifies for the EB-2 NIW through the same three prongs as everyone else, and USCIS does not describe a separate R&D fast-track program in its NIW guidance. Entrepreneurs face extra scrutiny, and ownership alone rarely establishes eligibility (USCIS Policy Manual).

Older versions of this page called it a fast-track program with its own investment test. That is not how USCIS describes the NIW, so we corrected it.

How does an R&D endeavor fit the three prongs?

  • Prong 1: the research has substantial merit and national importance, which means impact beyond one company.
  • Prong 2: you are well positioned, with a record, a plan, progress and support from others.
  • Prong 3: on balance, waiving the job offer benefits the United States.

Read prong 1 and prong 2 for the detail.

What evidence helps an R&D founder?

USCIS lists the kinds of proof it may consider for entrepreneurs. They include U.S. company ownership, outside investment, incubator or accelerator participation, grants, intellectual property, media coverage, revenue growth and third-party letters (USCIS Policy Manual).

  • Intellectual property: patents and filings tied to the research.
  • Funding: grants and outside investment.
  • Partners: research institutions, customers and users who support the work.
  • Results: publications, prototypes, pilots and revenue.

How do you build the case?

Step 1: Confirm your EB-2 base, an advanced degree or its equivalent, or exceptional ability.

Step 2: Write one specific research endeavor. See how to write it.

Step 3: Gather proof of progress and outside support.

Step 4: Add specific letters from experts who know the work.

What if your company is the main proof?

Ownership alone rarely establishes eligibility, so the file should show the wider benefit of the research and your own role in it. Compare the option with the EB-1A in EB-1A vs EB-2 NIW, and see other routes for founders.

Read the plain guide to the NIW for the full overview.

Frequently asked questions

Is there an EB-2 NIW R&D program?

USCIS does not describe a separate R&D program. R&D founders file under the regular NIW and meet the same three prongs (USCIS Policy Manual).

Is the R&D route a fast track?

No separate fast track is described in USCIS NIW guidance. Premium processing is a separate paid option for faster handling.

Do entrepreneurs qualify for the NIW?

Some do, but not every entrepreneur does. Ownership alone rarely establishes eligibility (USCIS Policy Manual).

What evidence helps a founder?

Intellectual property, grants, outside investment, partner support, results and specific letters from experts (USCIS Policy Manual).

Do I need an employer?

No. The NIW lets you file for yourself and waives the job offer and the labor certification (USCIS).
