Canada C11 vs U.S. E-2: Which Business Route Fits You?

Canada C11 vs US E-2 visa business routes
In this article

The C11 and the E-2 are both temporary routes for business owners, and neither one leads directly to permanent residence. The E-2 needs treaty-country citizenship and a substantial investment, and the C11 needs a business that brings significant benefit to Canada (USCIS, IRCC).

Your passport usually decides this before anything else. Start there.

Does your passport qualify?

The E-2 is open only to citizens of treaty countries. Canada and Pakistan are on the State Department list. India, mainland China, the UAE and Nigeria are not (U.S. Department of State, Oct 2026). The C11 is not tied to a treaty list, so foreign nationals from many countries can apply.

How do the two routes compare?

Criteria U.S. E-2 Canada C11
Who can apply Citizens of treaty countries Foreign nationals with a qualifying business plan
Core test Substantial investment at risk in a real, active, non-marginal business A business that creates or keeps significant social, cultural or economic benefits, or jobs for Canadians and permanent residents
Work permit test E-2 status through a consulate or USCIS Work permit without a Labour Market Impact Assessment
Ownership At least 50 percent or operational control Judged on the plan and the benefit
Permanent residence Not directly; needs a separate route Not directly; needs a separate route

Sources: USCIS (Aug 2026) and IRCC (help centre answer last modified 28 Sep 2026).

How does the investment test differ?

The E-2 asks for a substantial amount at risk, measured against the cost of the business. USCIS says the capital must be subject to partial or total loss if the business fails (USCIS, Aug 2026). The C11 sets no fixed amount either, and officers look at whether the business benefits Canada (IRCC).

A strong plan matters in both countries. Read our guide to the E-2 investment amount and our Canadian page on the entrepreneur work permit.

What about your family?

On the E-2, your spouse is authorized to work, and your unmarried children can come until they turn 21 (USCIS, Aug 2026). Plan for the year your children age out. Our guides to E-2 vs C11 and the U.S. green card routes show what comes next.

Can either route lead to permanent residence?

Not directly. The E-2 requires you to plan to leave, so a U.S. green card needs a route such as the EB-2 NIW, the EB-1A or the EB-5. In Canada, a business permit also has to be followed by another route. See Canadian provincial business immigration for pathways that lead to permanent residence.

How do you decide?

Step 1: Check your passport against the E-2 treaty list.

Step 2: Write down your long-term goal: a temporary business base or permanent residence.

Step 3: Compare your budget and your family plans against each test.

Step 4: Take the E-2 eligibility check for the U.S. side, or Book a Strategy Consultation for the Canadian side.

Frequently asked questions

What is the main difference between the C11 and the E-2?

The E-2 is only for citizens of treaty countries and needs a substantial investment at risk. The C11 is for foreign nationals whose business will bring significant benefit to Canada (USCIS, IRCC).

Does the C11 need a Labour Market Impact Assessment?

No. IRCC says an entrepreneur can apply for a work permit without an LMIA if the business would create or maintain significant social, cultural or economic benefits, or jobs for Canadians and permanent residents (IRCC, Sep 2026).

Can the E-2 lead to a green card?

Not directly. The E-2 requires you to plan to leave when your status ends, so a green card needs a separate route (USCIS, Aug 2026).

Which countries can use the E-2?

Only citizens of treaty countries. Canada and Pakistan are on the State Department list, and India, mainland China, the UAE and Nigeria are not (U.S. Department of State, Oct 2026).

Can my children stay with me on the E-2?

Unmarried children under 21 can come with you. They cannot work, and they must change status or leave when they turn 21 (USCIS, Aug 2026).
