Online or proxy marriage does not count for spousal sponsorship in Canada. Under section 5(c) of the Immigration and Refugee Protection Regulations (IRPR), you are not a spouse if either of you missed the wedding. Immigration, Refugees and Citizenship Canada (IRCC) says the same thing in its Help Centre.
This guide sets out the online marriage spousal sponsorship rules. It also covers the one exception. Then it shows the routes that may still be open.
Will IRCC accept an online marriage for spousal sponsorship?
No, IRCC will not accept an online or proxy wedding as a marriage. Its Help Centre answer on proxy, phone, internet and fax marriages says IRCC does not recognize them. That page, changed October 30, 2026, says a marriage fails if either person was not there in person.
IRCC’s sponsorship Guide 5289 says the same thing. It names marriages “by proxy, telephone, fax, Internet” and the like. In each one, one or both people were not there.
This holds even if the marriage is legal where it took place. Canada adds its own test.
Which spouses does paragraph 5(c) exclude?
Paragraph 5(c) shuts out a spouse when one or both of you were not at the wedding in person. Section 5 of the IRPR lists ties that never count for a sponsor, however real they feel. The rules are current to September 30, 2026, and were last changed July 15, 2026.
Section 5 has three paragraphs. Each one shuts out a spouse in its own way.
- Section 5(a): a person under 18 is not a spouse or common-law partner.
- Section 5(b): a person is not a spouse if either partner was still married to someone else at the wedding. They are also not a spouse if the sponsor has lived apart from them for at least one year and now has a common-law partner.
- Section 5(c): a person is not a spouse if one or both partners were not at the wedding in person.
Section 2 adds one more rule. A marriage abroad must be valid where it took place and under Canadian law. Our guide to the spousal sponsorship eligibility test covers the other bars.
Both of you in one room, officiant on video: does it count?
The rule looks at the two spouses, not at the person who runs the wedding. Section 5(c) asks if “either one or both of the spouses were not physically present” at the wedding. It says nothing about the officiant, yet IRCC lists internet marriages as ones it will not accept.
So this setup carries real risk. We cannot confirm how an officer will treat it. IRCC has not posted advice on this exact case, so get advice before you file.
Is there an exception for the Canadian Armed Forces?
Yes, there is one narrow exception for members of the Canadian Forces. Paragraph 5(1)(c) of the Immigration and Refugee Protection Regulations (IRPR) does not apply where a spouse was not physically present at the ceremony as a result of their service as a member of the Canadian Forces, provided the marriage is valid both under the laws of the jurisdiction where it took place and under Canadian law.
IRCC’s Help Centre adds three conditions.
- Service: the member could not attend because of travel limits from military service.
- Place: the marriage took place outside Canada.
- Registration: it was registered in a country where proxy marriage is legal.
The Help Centre also exempts sponsorship applications IRCC received before June 10, 2015. IRCC’s officer instructions use June 11, 2015.
Online marriage refused for spousal sponsorship: is common-law or conjugal an option?
Sometimes, yes, because section 5(c) only stops you from being a spouse. The common-law and conjugal classes have their own tests in sections 1(1) and 2 of the IRPR. If you meet one of them on its own facts, that route may be open.
- Common-law partner: Guide 5289 says you must have lived together for at least 12 months in a row. The tie must be like a marriage.
- Conjugal partner: the partner lives outside Canada and you have been together at least one year. Marriage or living together has not been possible.
Both classes still need strong proof that the relationship is real. Our 4-pillar framework for spousal sponsorship evidence shows what officers look for. Read our list of red flags that lead IRCC to refuse sponsorships too.
How do couples fix an online marriage before applying?
The cleanest fix is a new wedding where both of you are there in person. That removes the section 5(c) problem in an online marriage spousal sponsorship case. But local law may not let the same two people marry again, so check with the civil office first.
If a second ceremony is not possible, look at the common-law or conjugal routes above. Do not describe an online marriage as an in-person wedding. Section 40 of the Immigration and Refugee Protection Act (IRPA) makes misrepresentation a five-year bar.
Once you have a valid marriage, the proof matters. Guide 5289 says the certificate must show the marriage was registered with the government where it took place. It will not accept a marriage licence, or a record of solemnization obtained in Canada.

Frequently asked questions
Is a proxy marriage valid for Canadian immigration?
No, a proxy marriage is not valid for Canadian immigration. Section 5(c) of the IRPR says you are not a spouse if either of you was absent from the ceremony. The only exception covers some members of the Canadian Armed Forces.
Does the rule apply to marriages before 2015?
The cut-off depends on when IRCC got the application, not on the wedding date. IRCC’s Help Centre exempts sponsorship applications it received before June 10, 2015. Under SOR/2015-139, which brought IRPR paragraph 5(1)(c) into force on June 10, 2015, the rule applies only to sponsorship applications received after June 10, 2015. Any new application you file today falls under the current rule on online and proxy marriages.
Can I sponsor my partner if we married over Zoom?
No, you cannot sponsor them as your spouse. IRCC does not recognize internet marriages where either spouse was not there in person. You may still qualify as common-law or conjugal partners if you meet those tests on their own facts.
