Not always. The NIW removes the employer and the labor certification, which makes it easier to start, but it asks for a heavy evidence file. It suits you when your record is strong and your work has national reach (USCIS, reviewed Jan 2025).
Easy depends on your profile. Use the table and three questions below to judge yours.
How does the NIW compare with the standard EB-2?
| Criteria | EB-2 NIW | EB-2 with an employer |
|---|---|---|
| Who files Form I-140 | You can file for yourself | Usually a U.S. employer |
| Job offer | Waived | Required |
| Labor certification | Waived | Usually required |
| Main test | Three prongs: merit and national importance, well positioned, benefit to waive | Employer proves no qualified U.S. worker was found |
Source: USCIS EB-2 page (reviewed Jan 2025). USCIS also notes that certain Schedule A occupations do not need a labor certification.
What makes the NIW harder than it looks?
You carry the whole case. You must define one specific endeavor, prove its national importance, and show you are well positioned to advance it. USCIS may grant the waiver as a matter of discretion, even when you meet the base (USCIS Policy Manual).
Is it the right route for you?
Question 1: Do you qualify for EB-2, through an advanced degree or exceptional ability?
Question 2: Can you describe one specific endeavor with benefit beyond one employer?
Question 3: Can you prove progress with documents, results and letters?
If you answer yes to all three, the NIW is a strong option. If not, compare other routes. See EB-1A vs EB-2 NIW, the EB-5 and the U.S. green card options.
What if you are weighing Canada too?
Some professionals compare the NIW with Canadian Express Entry. Check your score on the CRS calculator and read about Express Entry and the provincial nominee programs. Canadian citizens have their own page: EB-2 NIW for Canadians.
